Patent Procedure
Application and formality examination: The application is filed with the Myanmar Intellectual Property Department (IPD). The filing requirements are reviewed, the filing date is established and the invention is classified under the International Patent Classification (IPC).
Publication of the application: The application is published under the applicable publication procedure. Earlier publication may be requested where appropriate.
Request for examination: A request for substantive examination must be filed within the prescribed period. The request is published in accordance with the applicable procedure.
Substantive examination: The invention is assessed against the patentability requirements. We assist with examination responses and any further instructions required from the associate.
Decision, certificate and maintenance: The IPD decides whether to grant or refuse the application and publishes the decision. Where granted, a patent certificate is issued and annual fee payments are required for maintenance.
Utility Model Procedure
Utility model (petty patent) applications follow a separate procedure from patent applications.
Application and formality examination: The application is filed with the IPD. The filing requirements are reviewed, the filing date is established and the invention is classified under the IPC.
Publication of the application: The application is published under the applicable utility model procedure. Any opposition is addressed through the relevant proceedings.
Decision on grant or refusal: The application proceeds to a decision under the utility model procedure, without the separate patent substantive-examination request stage described above.
Certificate and maintenance: The decision is published. Where granted, a utility model certificate is issued and annual fee payments are required for maintenance.

Payment and instructions: Once payment, the notarized PT/UM-2 PDF and filing instructions have been received, we prepare the application draft.
Application draft for approval: We send the draft for your review and confirmation before filing.
Filing and reporting: Following your confirmation, we file the application and email the filing receipt once available. We communicate office actions, deadlines and any further instructions required in a timely manner.
